While reviewing the policy forms for a proposed pollution liability policy, I came across a “cyber acts clarification endorsement,” which states that the policy does not contain a specific exclusion for cyber acts or cyber incidents and that coverage shall be provided under the policy for any pollution condition in connection with a cyber act or cyber incident. Given that pollution exclusions are common on cyber liability policies, the fact that a pollution policy is confirming and affirmatively granting coverage for pollution events arising from cyber acts is nice to see. This is particularly true when compared to general liability policies where a gap in coverage often exists between the GL and cyber policies in relation to third-party bodily injury and property damage claims arising from cyber incidents. At the very least, given the existence of such a form, coverage should be sought for cyber incidents on all pollution liability policies.
